Riders who are 21 or older and have held a license for more than a year may legally ride without a helmet.
Kentucky’s pure comparative negligence rule actually asks two different questions, and it helps to keep them separate.
The first question is who caused the crash. Not wearing a helmet did not cause a driver to run a red light, turn into your lane, or drive distracted, so helmet use has no bearing on who is at fault for the collision itself.
The second question is whether anything you did made your injuries worse once the crash happened. This is where insurance companies try to bring a helmet into the conversation, arguing that a head injury would have been less severe with one and that damages should be reduced.
Even that second argument only reduces your compensation if it holds up, and it holds up less often than adjusters imply.
